What severance am I entitled to if terminated without cause?

Minimum entitlements under employment standards are typically one week of service per year. However, common law entitlements are often significantly higher – potentially one month per year or more, depending on factors such as age, position, and the job market. Employment contracts may limit entitlements, though not below statutory minimums. We calculate your full entitlements.

Can I be fired for any reason in Nova Scotia?

No. While employment is generally “at will,” employers must provide proper notice or pay unless there’s just cause for immediate termination. Just cause requires serious misconduct, such as theft, violence, or repeated misconduct despite warnings. Employers often claim incorrectly. Additionally, termination cannot violate human rights – firing someone for discriminatory reasons is illegal.

Should I sign the severance package offered?

Never sign immediately. Most packages include releases preventing future claims. Initial offers are often below your entitlements. You typically have time to seek legal advice – employers who pressure immediate signing often know their offers are inadequate. We review packages and negotiate better terms, often doubling or tripling initial offers.
